The agency's new rulemaking push for retail leveraged crypto trading faces a clock set by the next election cycle
The Commodity Futures Trading Commission has started building a federal home for leveraged retail crypto trading. TD Cowen thinks the construction schedule may not beat the 2028 election cycle.
That matters because rules written by an agency can be rewritten by that agency. If the political winds shift before the framework is finished, the whole project could be reopened or shelved.
What the CFTC actually proposed
On October 5, 2026, the CFTC issued an advance notice of proposed rulemaking, or ANPRM. The notice asks the public to weigh in on a tailored federal framework for retail commodity transactions in crypto assets that involve leverage, margin, or financing.
The proposal has two main pieces. The first is Regulation CTX, which aims to spell out which transactions fall under CFTC authority via Section 2(c)(2)(D) of the Commodity Exchange Act.
The second piece is Regulation CAM. It would carve out a specialized “crypto asset markets” category within designated contract market registrations, giving platforms offering leveraged crypto products a dedicated lane to operate under federal oversight.
None of this is binding yet. The ANPRM opens a 60-day comment period once it appears in the Federal Register, and it does not put any rules into effect.
Why the clock is the problem
TD Cowen’s concern centers on durability. Analysts at the firm, including Jaret Seiberg, have flagged that agency rules are less stable than legislation passed by Congress. Future commissioners can modify agency rules or eliminate them outright.

CFTC Chairman Michael Selig has acknowledged the stopgap nature of the effort. He has described the approach as a temporary solution meant to provide oversight while legislative efforts remain stuck.
How we got here
The CFTC’s move follows the collapse of a more ambitious plan. The Clarity Act, which sought comprehensive crypto market structure legislation, stalled in the Senate in September 2026.
With the legislative route blocked, the CFTC turned to the tools it already has. The October 5 notice arrived within weeks of the Senate setback.
Selig’s approach aims to bring these platforms under a single federal framework instead of leaving them to navigate a patchwork of state jurisdictions.
What this means for exchanges and traders
For crypto platforms hoping to offer leveraged products to US retail customers, the ANPRM is a genuine opening. Regulation CAM would create a registration path tailored to their business rather than forcing them into ill-fitting categories.
Industry participants recognize the process could stretch into future election cycles, raising concerns about market clarity and investor confidence.
TD Cowen’s warning effectively argues that the only durable fix is legislation. Until lawmakers revive something like the Clarity Act, agency action remains a provisional patch on a structural gap.

US Stock Market Today: Wall Street opened with a mixed performance on Monday, October 12, as investors assessed rising crude oil prices, geopolitical developments, the start of the third-quarter corporate earnings season and upcoming US inflation data. The Dow Jones Industrial Average and S&P 500 edged higher at the opening bell, while the Nasdaq Composite slipped slightly.
According to Reuters, the Dow Jones rose 92 points, or 0.18%, to 51,746.95 at the open. The S&P 500 gained 4.18 points, or 0.05%, to 7,815.72, while the Nasdaq Composite fell 12.89 points, or 0.05%, to 27,353.28.
The cautious start came as Brent crude prices climbed above $106 per barrel, raising concerns about energy costs and their potential impact on inflation. Investors are also preparing for quarterly results from major US banks and economic reports that could influence the Federal Reserve’s interest-rate outlook.
US Stock Market Today: Dow Jones, S&P 500 & Nasdaq Performance
The three major US stock indexes moved in different directions at the opening bell on Monday. The modest changes indicated a cautious start rather than a broad-based rally or sell-off.
Dow Jones Today: The Dow Jones Industrial Average rose 92 points, or 0.18%, to 51,746.95 at the open.
S&P 500 Today: The S&P 500 advanced 4.18 points, or 0.05%, to 7,815.72.
Nasdaq Today: The Nasdaq Composite slipped 12.89 points, or 0.05%, to 27,353.28.
These figures reflect the opening session, not the final closing levels. The indexes may change direction as investors react to oil prices, company announcements and economic developments throughout the trading day.
Dow Jones Today
The Dow Jones Industrial Average rose 92 points, or 0.18%, to 51,746.95 at the opening bell on Monday, October 12, 2026. The index started the week on a slightly positive note as investors assessed the impact of rising crude oil prices, upcoming corporate earnings and the outlook for US inflation. Market participants are also monitoring geopolitical developments and their potential effect on energy costs, business confidence and consumer spending. The performance of major financial, industrial and energy companies could influence the Dow’s direction as the trading session progresses. However, the opening gain does not establish whether the index will maintain its upward momentum through the close.
S&P 500 Today
The S&P 500 advanced 4.18 points, or 0.05%, to 7,815.72 at the opening bell on Monday, reflecting a largely cautious start for the broader US equity market. Investors are weighing corporate earnings expectations against concerns about elevated oil prices, inflationary pressures and borrowing costs. The benchmark index’s performance will also depend on how investors respond to upcoming economic reports, particularly the September Consumer Price Index (CPI) and other indicators of consumer demand. Strong corporate results and an encouraging economic outlook could support equities, while persistent inflation or weaker earnings guidance could increase pressure on stocks. Investors will be watching whether the S&P 500 can build on its initial gains during the session.
Nasdaq Today
The Nasdaq Composite fell 12.89 points, or 0.05%, to 27,353.28 at the opening bell on Monday, October 12, as technology-heavy stocks started the session slightly lower. The index remains particularly sensitive to changes in interest-rate expectations and Treasury yields because higher borrowing costs can affect company valuations and future earnings projections. Investors are also assessing whether major technology companies can sustain earnings growth amid changing economic conditions and persistent uncertainty over inflation. Developments in artificial intelligence, corporate investment plans and upcoming earnings announcements could influence sentiment towards technology and growth stocks. However, the marginal opening decline alone does not indicate a broader sell-off, and the Nasdaq’s direction could change as fresh market developments emerge.
Brent Crude Oil Price Today
Oil prices remained a major factor influencing Wall Street sentiment on Monday. Brent crude futures climbed above $106 per barrel, reaching their highest levels in approximately two weeks, according to Reuters reporting.
The rise followed deadly strikes at Riyadh’s international airport over the weekend, adding to concerns about geopolitical risks and potential disruptions to energy supplies. Higher crude prices can increase transportation, manufacturing and logistics costs, potentially putting additional pressure on businesses and consumers.
For stock-market investors, sustained increases in oil prices could complicate the inflation outlook. Energy companies may benefit from stronger crude prices, but higher fuel and operating costs can weigh on airlines, transportation companies and other fuel-intensive businesses. Investors are therefore watching whether oil prices maintain their gains or retreat as geopolitical developments evolve .
US Treasury Yields Today: Bond Market Signals Remain in Focus
Treasury yields remain an important consideration for investors assessing the outlook for US equities. Higher yields can make bonds more attractive relative to stocks and increase borrowing costs for businesses and households.
The benchmark 10-year Treasury yield recently approached levels last seen more than two decades ago, adding to concerns about financing costs and the valuation of growth-oriented companies. Technology stocks can be particularly sensitive to rising yields because their valuations often depend on expectations of earnings further into the future.
However, the US Treasury market is closed on Monday for Columbus Day. Investors should distinguish between live Treasury-market trading and indications from other securities that may reflect changing bond-price expectations.
US Stock Market Today: Bank Earnings Season Begins
Quarterly corporate earnings are another key focus for Wall Street this week. Major US financial institutions, including JPMorgan Chase, Goldman Sachs, Wells Fargo and Citigroup, are among the companies investors are watching as the third-quarter reporting season gets underway.
Bank results may provide insight into consumer spending, loan demand, credit quality, investment-banking activity and the outlook for lending margins. Investors will also examine company guidance for signs of whether businesses expect economic conditions to strengthen or weaken in the coming months.
Results that exceed market expectations could support stocks, while cautious forecasts or signs of rising credit stress could put pressure on financial shares and the broader market. The earnings season is particularly important because investors are trying to determine whether corporate profit growth can sustain elevated equity valuations amid higher energy prices and borrowing costs.
US Inflation Data Today: Why Investors Are Watching CPI
Upcoming US inflation data is likely to be one of the biggest market catalysts this week. Investors will examine the September Consumer Price Index (CPI), along with other economic releases, for clues about the pace of price increases and the direction of monetary policy.
Higher oil prices could complicate the inflation outlook by increasing energy and transportation costs. If inflation remains persistent, the Federal Reserve may have less room to ease monetary policy. Conversely, softer inflation data could help ease concerns about further tightening.
Investors are also monitoring retail sales and other economic indicators to assess whether consumer demand remains resilient despite elevated prices and borrowing costs.
The actual market response will depend on how the incoming data compares with economists’ expectations, rather than simply whether inflation rises or falls.
Federal Reserve Interest Rate Outlook: What Could Move Wall Street?
The Federal Reserve’s next policy decisions remain central to the US stock market outlook. Investors are weighing inflation risks against signs of economic resilience and the potential effect of higher interest rates on borrowing, business investment and consumer demand.
Rising energy prices could reinforce inflation concerns, while elevated Treasury yields may tighten financial conditions even before the central bank announces any policy change. For equities, the combination of oil prices above $100 per barrel, high bond yields and uncertainty about future monetary policy could contribute to increased volatility. Strong earnings and encouraging economic data, however, could help offset some of these pressures.
No single opening move confirms the direction of the market for the rest of the session. Investors will need to assess incoming economic data, corporate results and Federal Reserve signals together.
Is the US Stock Market Open Today, October 12, 2026?
Yes. US stock exchanges are open for regular trading on Monday, October 12, 2026. However, the US Treasury market is closed for Columbus Day, which means government bond trading does not follow its normal schedule.
Investors should also remember that opening index figures are not closing prices. The Dow Jones, S&P 500 and Nasdaq can move in either direction before the end of the session.
US Stock Market Today: What Should Investors Watch Next?
Wall Street’s direction will depend on several competing factors: crude oil prices, geopolitical developments, corporate earnings, Treasury yields and the latest inflation readings.
The Dow Jones and S&P 500 started Monday slightly higher, while the Nasdaq Composite opened marginally lower. This mixed performance reflects uncertainty over whether earnings strength can offset concerns about inflation and borrowing costs. Investors should monitor the latest market prices and company announcements before drawing conclusions about the session’s direction. The opening figures alone do not establish whether Wall Street will finish the day higher or lower.

President Trump has been appearing around the US in the run-up to the midterm elections, announcing economic development projects — from a possible pipeline in Alaska to a steel plant in Iowa to an aluminum smelter in Oklahoma — that he says will transform the country.
"In the real economy, we are blowing it away," he said at a weekend stop in Tennessee .
Trump's message of confidence comes as the ultimate shape of these projects remains far from certain and often directly echoes his pitch at this stage in the 2018 midterm elections, a Yahoo Finance review found.
That election eight years ago was the last time Trump faced midterm voters and also saw him tout projects — most notably a Foxconn electronics manufacturing plant planned for Wisconsin — that turned out to be less than advertised.

"FoxConn … had a ribbon-cutting a few months ago," Trump said at a stop in Wisconsin on the eve of the 2018 election , pledging that the project was set to bring in "almost 15,000 jobs and there is no plant like it in the United States."
But the company eventually scrapped much of its manufacturing plans at the site and shifted the focus to data centers. Today, it employs only a reported 1,200 people at the site.
The president's penchant for promises is on display again as Election Day nears.
On Tuesday, he is set to travel to Alaska to tout a proposed $50 billion gas pipeline between South Korea and Alaska that could help Republican Sen. Dan Sullivan fend off a Democratic challenge.
Trump unveiled the project earlier this month in the Oval Office with Sullivan at his side, but South Korean officials immediately pushed back, saying no final investment decision has been made .
Korean President Lee Jae Myung even added that the deal will only proceed once the project's "commercial viability is confirmed."

Trump's promises in recent weeks have also included a $4 billion aluminum processing plant in Oklahoma. But local opposition to that plan — citing possible toxic chemicals and rising electricity prices — has led the town's mayor and a board of trustees to pause zoning approvals, leaving the fate of the project up in the air.
Even the project's developers recently reported to the SEC that "to complete this project, we will need to obtain substantial additional financing, and there can be no assurance that such financing will be available."

Robinhood Chain counts 200,000 stock token holders, while Morpho's dashboard shows about $1.1 billion deposited on the network
Robinhood Chain has reached its first 100 days. The company says its stock tokens have already logged $15 billion in cumulative trading volume.
That is a lot of tokenized Apple and Tesla exposure for a network that did not exist at the start of the summer. Robinhood also says the tokens now have about 200,000 holders. Morpho’s dashboard shows about $1.1 billion deposited on the network.
The numbers behind the first 100 days
Robinhood Chain is an Ethereum Layer-2 network built on the Arbitrum Orbit stack. Its mainnet launched on July 1, 2026, and the chain passed roughly 100 days of operation by mid-October.
The headline metric is the $15 billion in cumulative Stock Token volume since launch. September was a heavy month. Robinhood captured about 42% of on-chain equity trading volume that month, which works out to $6.57 billion.
The holder count, which the company puts at around 200,000, offers a second measure of adoption. Volume can be inflated by a handful of active traders. Wallet counts suggest how wide the user base actually is.
Then there is the DeFi side. Morpho, a lending protocol, shows about $1.1 billion deposited on Robinhood Chain through its dashboard. Much of that activity centers on lending markets and vaults that use the tokenized assets.
What a stock token actually is
Robinhood’s Stock Tokens are ERC-20 tokens, the standard format for most assets on Ethereum. Legally, they are tokenized debt securities issued by Robinhood Assets (Jersey) Limited.
Each token is backed 1:1 by the underlying equity held in custody. Holders get economic exposure to US stocks and ETFs, meaning price moves flow through to them.

What they do not get is ownership or voting rights in the underlying companies.
The tokens trade around the clock on decentralized exchanges such as Uniswap. Users can also plug them into Morpho to lend them out or post them as collateral for loans.
Access is currently limited to users outside the US, UK, and Canada. On the technical side, the chain uses ETH for gas fees and posts block times under 100 milliseconds. It has also seen rapid growth in DEX volume, users, and total value locked, along with occasional bursts of memecoin trading.
Why Robinhood built its own chain
Rather than leaning on another chain’s roadmap or fee market, it controls the settlement layer. Building on Arbitrum Orbit lets it customize the network while staying connected to Ethereum’s broader liquidity and tooling.
The research behind this report describes the offering as available in more than 120 jurisdictions.
What this means for traders, DeFi, and competitors
The Morpho figure is arguably more interesting than the trading volume. About $1.1 billion deposited on the network suggests users are not just flipping tokens. They are putting them to work as collateral and in yield strategies.
The competitive picture is heating up. BNB Chain and Solana are also chasing tokenized equity activity. A 42% monthly share is a strong position, but share is something that can be won and lost.
Because the tokens are structured as debt securities, holders depend on the issuer and custody arrangement rather than holding the shares outright. Holders also lack the governance rights that come with real equity.
The exclusion of US, UK, and Canadian users is the other big variable. Those markets hold a large share of Robinhood’s existing customers.

Jeffrey Katzenberg’s new AI-video startup is reportedly in discussions to leverage OpenAI’s shelved video-generation model, Sora. The startup, co-founded by Katzenberg along with former OpenAI Sora lead Bill Peebles and former Dropbox CFO Sujay Jaswa, aims to offer solutions for professional filmmakers. OpenAI had previously halted consumer-facing developments of the Sora model, but this potential collaboration could allow the startup to customize and commercialize it, potentially offering OpenAI an equity stake. While the startup remains unnamed, the move could signify a revitalization of OpenAI’s video initiatives, aligning with its interests in expanding AI applications in media.
Key Takeaways
The potential collaboration between Katzenberg’s startup and OpenAI appears to suggest a renewed interest in the Sora video model.
Market pricing indicates that participants view this development as potentially supportive of an increase in OpenAI’s valuation by the end of the year.
Despite the optimistic scenario, the impact is moderated by the Tier 3 source, suggesting limited immediate influence on market expectations.
What to Watch
Observers will be looking for any official announcements regarding a partnership between OpenAI and Katzenberg’s startup, which could influence market sentiment. Confirmation of the startup’s name, product details, and OpenAI’s equity involvement would clarify the scope of the collaboration. Additionally, any related updates from OpenAI regarding new funding rounds or strategic partnerships could further affect market pricing and valuation forecasts.
